The Federal Supreme Court and its role in protecting the constitutional system in Iraq
Abstract
Studying the impact of the Constitutional Court in protecting the constitutional system in Iraq. requires us to know its formation. and jurisdiction before and after 2003 in Iraq. then its impact on strengthening the supremacy of the constitution, meaning that the Constitutional Supreme for the unconstitutional decisions issued by the ex-ecutive authority, its matter is entrusted to the administrative court. The constitution protects individual rights and freedoms from the abuses of the ruling authority. The Supreme Constitutional Court prohibits any breach in this aspect. Therefore, our study stopped at the experiences of others to draw lessons, and clarified the formation of The Supreme Court and its jurisdiction. in the two phases before and after 2003. then dealt with the protection of the constitutional system through the principle of the supremacy of the constitution and through its duty to interpret constitutional rules and preserve the rights of individuals. Court takes upon itself to abolish any law that contradicts the constitutional rules. It also abolish the wrong interpretation of these rules, as it is not permissible to issue a law from the legislative authority, or it contradicts the consti-tution, or with any of its rules. The Supreme is what the constitution has decide. or-ganizing life necessarily is achieved by applying its rules that came as an expression of the popular will. As for the unconstitutional decisions issued by the executive au-thority, within the responsibility of the administrative court. The constitution protects individual rights and freedoms from overstepping the ruling authority. The Supreme Constitutional Court prohibits any breach in this aspect. Therefore, our study stopped at the experiences of others in this aspect. and the formation of the Supreme Court clar-ified. And its competence. in the two stages before and after 2003. and then dealt with the protection of the constitutional system, and that was through the principle of the supremacy of the constitution, through its duty to interpret the constitutional rules and preserve the rights of individuals.
