Deferred dowry according to Islamic law
Abstract
The amended Iraqi Personal Status Law ۱۸۸ in ۱۹۵۹، Article defines marriage: It is a
contract between a man and a woman and according to Islamic legal with the aim of creating a bond for a shared life. According to this relationship rights and duties arise for each of them. When concluding a contract the wife has rights that the husband is obligated to. It is justice and benevolence in the way of dealing with the wife.
Al-Aslam is concerned with organizing society as well as building it on solid foundations and clarifying the rights of both parties. Married life is considered the first building block in building the family and society as stated in the Holy Qur'an in Surat Al-Hujurat verse ۱۳ and Surat Al-Nisa verse ۲۱۰ This is the will of God in creation formation، for the purpose of reproduction the continuation of life and its construction in the form of societies.
Perhaps problems will arise between the two parties and they will become complicated and life will become impossible. Here the issue of dispute is presented to the judiciary. The law regulates the state of divorce and this principle is known among the peoples of the earth.
The right to divorce is available to both men and women according to the terms and conditions guaranteed by legal rules. The man has the right to divorce and according to the law the judge must approve that. God wanted happiness for human beings.
When it becomes impossible to live together. God permitted divorce but the judge must investigate that there is no way to reform their lives and maintain the family..
