Legislative failure in criminalizing intercourse with a female after seducing her with the promise of marriage

Abstract

Different societies suffer from manifestations that may indicate a serious danger towards a specific group of society especially the weak ones such as women so they are rushing to find effective solutions to them. The truth is that the Iraqi legislator has surrounded the marital relationship as a sacred bond with a special protection that is compatible with its importance in society and the family together because its effects begin between two spouses to expand families and then society so it was necessary to organize it in a precise manner that preserves its sanctity and for this we note that the protection is not limited to the marital relationship yet Its becoming a fait accompli. Rather that protection included marriage as a legitimate means of reproduction from everything that offends him including the man's exploitation of the legality of marriage as a means to entrap a female after being deceived by her for the purpose and position of her which is the focus of our study in this research through which we will show the shortcomings of the legal text that regulate of this crime.
