Abstract

There is no calamity that is not in the law of God that has the rule of his knowledge from his knowledge and his ignorance from his ignorance. Many calamities have arisen in this era, especially in the chapters of financial transactions that are limited to many developments and calamities; Therefore, it was necessary for scholars and students of knowledge to roll up their sleeves to discuss these developments, and to explain their ruling, as it is an obligation of sufficiency on the nation, and one of the calamities in the field of financial transactions that moved to Islamic countries in this era is the penalty clause, or (consensual compensation), the subject necessitated to be divided into three sections; The first topic showed the linguistic and idiomatic meaning of the condition and the penalty, and in the second section I talked about the penal condition in positive law, and in the third section
I outlined the talk on the subject of the impact of the penal condition.
