Abstract

The importance of determining the legal nature of the contract of sale of real estate on the design is due to determining the obligations of both parties and the responsibility resulting from the breach of these obligations. The sale of real estate by design is an ordinary sale contract including those who consider it a contracting contract while there are opinions of those who consider the sale contract to be a mixture between this sale and contracting on the one hand and on the other hand there are those who consider the contract to sell real estate by design a commercial contract and there are those who consider it a civil contract And there are also those who consider it an independent contract and accordingly we will discuss these opinions to clarify the relationship between the contract of sale of real estate on the basis of the design and the traditional sale contract and the contracting contract as well as to indicate whether the contract is of a commercial or civil nature or is it an independent contract.
