Conflict of common and metaphor and its impact on the elicitation of judgments
Abstract
The difference of scholars in the rules of deriving legal rulings had a great impact on their differences in speculative matters and opened the door to ijtihad. In order to expand the jurisprudential opinions and thus open the door to the taxpayers and not to restrict them in fatwas.
Hence the importance of studying one of the chapters that the fundamentalists called what violates understanding. to be identified when it conflicts with the common expressions, which in themselves constitute difficulty in determining their meaning; In order for the taxpayer to carry out the Sharia ruling in accordance with what is intended by the wise Sharia.
