Abstract

Ingeneral, the criminal law aims to protect the interests in accordance with the criminal policy that it follows, which is a reflection of the values and ideas prevailing in society. The interests protected under the law are categorized into either public; aimed at protecting society, or private; aimed at protecting the private interests of individuals. Accordingly, the protected interest forms the subject of criminalization and is the basis on which the legislator relies in the formation of the crime. The private protected interest is those claims and desires directly related to the individual life, which are aimed at satisfying special needs. These needs are protected by the criminal legislator who provides legal protection via criminalization and punishment provisions. The private protected interest plays an important role both in the criminal policy followed by the legislator by selecting these interests and indicating their importance and the role in the provisions of the general section of the Penal Code as well as in the criminalization and punishment provisions in the special section.
