من القواعد الفقهية المهمة قاعدة )لا ضرر ولا ضرار( التي تزايد في الآونة الأخرةالعمل بها، لكثرة المستجدات في مسائل الزنا، وتعدد الفتاوى الصادرة بشأنهما، فرغبتفي جمع ما تفرق منها، لتسهل الوصول إليها، ومناقشتها وبيان الراجح منها.وسعى البحث لبيان رأي الفقهاء في إجهاض الجنن، واختيار الرأي الراجح منالمسألة، وهو الذي يجيز إسقاط الجنن قبل مي أربعة أشهر استنادا إلى هذه القاعدة.
