الملخص

عرف قانون األحوال الشخصية العراقي رقم 188 لسنة 1959 املعدل يف مادته
الثالثة الزواج بأنه عقد بني رجل وأمرأه حتل له رشعا غايته أنشاء رابطة للحياة املشرتكة
والنسل. وان عقد الزواج يرتب حقوق وواجبات عىل كل من الزوج والزوجة فمنها
حقوق خاصة بالزوج ومنها حقوق خاصة بالزوجة ومنها حقوق خاصة بينهام. وعند
أبرام عقد الزواج ينشأ للزوجة عىل زوجها حقوق يلزمه القيام هبا وهذه احلقوق بعضها
مايل وهي املهر والنفقة وبعضها غري مايل وهي العدل واإلحسان يف املعاملة.
