Abstract

تعد محكمة قضاء الموظفين احدى تشكيلات القضاء الإداري في العراق، وهي تقوم بدور فعال في حماية حقوق الموظفين من جهة والإدارة من جهة أخرى، والفصل في المنازعات القائمة بينهما، وفي نفس الوقت تعتبر جهة مختصة ومرجع للطعن في القرارات التي يتم فيها فرض عقوبة على الموظف من قبل الإدارة، وان وجود الرقابة القضائية على مشروعية التصرفات التي تصدر من الإدارة تجاه الموظفين يمثل ضمانه مهمة من ضمانات حقوق الموظفين وحرياتهم، لذلك لابد من وجود ضمانات تخص إجراءات التقاضي امام محكمة قضاء الموظفين، على اعتبار ان هنالك طرفين في النزاع المعروض امامها من خلال الدعاوى، ولكي لا يكون هنالك غلبة لطرف معين، وللحد من تعسف الإدارة في قراراتها على موظفيها، ومراعاة الإجراءات الشكلية والموضوعية في الدعاوى المقامة امامها.
